1. Introduction
These Terms of Use govern your access to and use of the IncludeDeaf Ltd online learning platform (“Platform”).
By accessing or using the Platform, you agree to comply with these Terms of Use.

2. Access to the Platform
Access to the Platform is provided to you by your organisation or programme sponsor.
You are granted a personal, non-transferable, limited licence to use the Platform for learning purposes only.
You must:
- Use only your assigned login credentials
- Access the Platform for your own learning
- Comply with all applicable laws and organisational policies
3. Technical Requirements
You are responsible for ensuring that you have:
- a suitable device capable of accessing the Platform
- a stable internet connection
- a compatible and up-to-date web browser
IncludeDeaf Ltd is not responsible for access issues arising from user devices, connectivity, or local system configurations.
4. Account Security
You are responsible for maintaining the confidentiality of your login credentials.
You must not:
- Share your login details with others
- Allow others to access the Platform using your account
- Attempt to access another user’s account
IncludeDeaf may monitor account activity to detect misuse or unauthorised access.
5. Acceptable Use
You agree to use the Platform in a lawful, respectful and appropriate manner.
You must not:

- comply with any policies or requirements set by your organisation in relation to use of the Platform
6. Licence Restrictions
Your access is based on a named user licence.
You must not:
- Share your account
- Allow concurrent use by multiple users
- Provide access to individuals outside your organisation
- Exceed the scope of your assigned access
Misuse may result in suspension or removal of access.
7. Learning Content & Intellectual Property
All Platform content, including:
- Training materials
- Videos and recordings
- Course content
- Digital resources
are the intellectual property of IncludeDeaf Ltd (unless otherwise stated).
You may use content for personal learning only.
You must not copy, distribute, or reuse content without prior written permission.
8. Recordings
Some sessions may be recorded for training, quality assurance, and accessibility purposes.
Where recordings are used:
- You will be informed at the start of the session
- Recordings are available only to authorised participants
- Recordings must not be downloaded, shared, or redistributed
If you have concerns about being recorded, you should notify the facilitator at the start of the session.
9. Monitoring & Usage
IncludeDeaf may monitor usage of the Platform to:
- Ensure compliance with these Terms
- Detect misuse or unauthorised activity
- Improve platform performance and user experience
Monitoring may include review of login activity, usage patterns, session participation, and licence compliance indicators to detect misuse, unauthorised access, or breaches of these Terms.
10. Data Protection
Your personal data is processed in accordance with applicable data protection laws.
IncludeDeaf acts as a data processor for your organisation in relation to Platform usage.

Where IncludeDeaf Ltd processes personal data on behalf of your organisation, your organisation acts as the data controller and IncludeDeaf acts as a data processor.
If you wish to exercise your data protection rights (including access, rectification or deletion), you should contact your organisation directly in the first instance.
11. Availability
IncludeDeaf aims to provide reliable access to the Platform but does not guarantee uninterrupted availability.
Access may be temporarily suspended for:
- Maintenance
- Security reasons
- System updates
The Platform relies on third-party service providers, including cloud hosting, email services, video platforms and analytics tools.
While IncludeDeaf Ltd selects reputable providers, we are not responsible for outages, disruptions or failures caused by third-party services outside our control.
While IncludeDeaf Ltd takes reasonable steps to maintain the integrity of user progress and learning data, there may be occasional technical issues, system updates or connectivity disruptions that result in loss of unsaved or recently completed progress.
Users are encouraged to ensure stable connectivity and to complete sessions fully where possible. IncludeDeaf Ltd shall not be responsible for loss of progress arising from factors outside its reasonable control.
12. Disclaimer & Limitation of Liability
The Platform and its content are provided on an “as available” and “as is” basis.
IncludeDeaf Ltd makes reasonable efforts to ensure that the Platform and its content are accurate, up to date and accessible. However, we do not guarantee that:
- the Platform will be uninterrupted or error-free
- defects will be corrected immediately
- the Platform will meet all individual user requirements
The Platform is provided for training and awareness purposes only. It does not constitute professional, legal or compliance advice, and should not be relied upon as such.
To the fullest extent permitted by law, IncludeDeaf Ltd shall not be liable for:
- any indirect or consequential loss
- loss arising from misuse of the Platform
- loss resulting from unauthorised access to user accounts
- reliance placed on Platform content beyond its intended purpose
Nothing in these Terms excludes or limits liability where it cannot be excluded under applicable law.
These Terms of Use operate alongside the IncludeDeaf Ltd Terms and Conditions, which contain further provisions relating to liability.
13. No Certification or Guarantee
The Platform provides training and awareness only.
Use of the Platform:
- Does not constitute certification
- Does not guarantee legal compliance
- Does not replace professional or legal advice
14. Suspension or Termination
IncludeDeaf may suspend or terminate your access if:
- These Terms are breached
- Misuse or unauthorised activity is detected
- Your organisation’s licence ends
IncludeDeaf Ltd may suspend or restrict access without prior notice where necessary for security, investigation, or to prevent suspected misuse.
Serious or repeated breaches of these Terms may be reported to your organisation.
15. Changes to These Terms
IncludeDeaf may update these Terms from time to time.
Where changes are material, users will be notified where reasonably practicable.
